Trial in jail illegal, BNP lawyers tell Chief Justice
Senior lawyers of Begum Khaleda Zia visited Chief Justice Syed Mahmud Hossain over setting up of special court at the old central jail premises for performing hearing of the Zia Charitable Trust case.
The BNP lawyers visited the Chief Justice at his office on Sunday.
Khondoker Mahbub Hossain, Jamiruddin Sircar, AJ Mohammad Ali, Zainul Abedin, Mahbub Uddin Khokon, Mir Nasir Uddin and Badruddoza Badal were present among the lawyers.
They filed a written application to the Chief Justice for taking steps following investigation against the judicial boundary violators. Three arguments were upheld there, such as-
First- health condition of Khaleda Zia is not well. She is severely ill and cannot walk, which the government also noticed. Still then, the government took no initiative for her proper treatment.
Second- trial cannot be held at any abandoned jail. If it takes place then it will be illegal.
Third- Dhaka old central jail is not excluded from the list of jails of the country-for that reason setting up of court at the old central jail without permission of the Supreme Court is illegal and contrary to the law.
In the written application the lawyers said to the Chief Justice, we request you that those who misused the judicial power and the official related violated the judicial boundary-action should be taken against them following investigation under rules 1973 of the Supreme Court (High Court division).
After the visit one of the lawyers of Khaleda Zia, Mahbub Uddin Khokon told the newsmen that a writ petition was filed with the High Court seeking directives for Khaleda Zia’s treatment in specialized hospital. The petition can come to the work list on Monday for hearing.
