The High Court has delivered order saying that anybody can donate kidney considering the humanitarian ground but it cannot be sold. The order also said that drug addicted persons and traders will not be allowed to donate kidney.
The verdict was delivered by the High Court double bench comprising Justice Moinul Islam Chowdhury and Justice Khondoker Diliruzzaman after hearing of a writ.
Barrister Rashna Imam stood for the writ petitioner before the court and lawyer Khondoker Nilima Yasmin assisted her. Deputy Attorney General Md. Saifuddin Khaled represented the state.
Earlier, on November 7 a committee comprising seven expert physicians submitted their opinion before the court on kidney transplantation.
The committee in its opinion said, there is no need of kidney transplant beyond relatives. If there is any opportunity created for kidney transplantation from anybody beyond relatives then the life of poor people will be turned risky. The rich people will commercially use it. The expert committee suggested that organ smuggling will increase if that is allowed.
